Former police officers can now claim medical and other expenses for injuries they sustained while employed by WA Police.
The Police (Medical & Other Expenses for Former Offices) Act 2008 was proclaimed on 16 June 2009. Under the legislation, former police officers can claim medical and other expenses incurred by a former officer on or after 1 July 2007.
Expenses must relate to a work-related injury or disease sustained while employed by Western Australia (WA) Police.
This new scheme commenced on 1 July 2009 and is based on the following framework:
- The scheme provides benefits in line with the Workers' Compensation and Injury Management Act 1981.
- Medical expenses for catastrophic injury/disease are excluded from this scheme and funded separately on a case-by-case basis.
- The scheme is funded by the Department of Treasury and Finance on an emerging cost (cash flow) basis for a period of three years. After this period full funding will be examined.
- The Insurance Commission of Western Australia has been appointed for an initial three-year period to assess and manage claims. The appointment will be reviewed prior to completion of this term.
- Assessment and management of claims in dispute will be undertaken with reference to the Workers' Compensation and Injury Management Act 1981. Former officers can access a two-stage dispute resolution process.
Stage 1: Internal Dispute Resolution Process within the Insurance Commission of Western Australia.
Stage 2: Referral to the WA Dispute Resolution Directorate within WorkCover WA, who is responsible for independently arbitrating disputes between parties related to the claims under the Police (Medical and Other Expenses for Former officers) Act 2008.
Who can claim and what can be claimed?
This scheme provides for payment of medical and other expenses incurred by former police officers and Aboriginal police liaison officers, following their separation from WA Police and must be in respect to employment-related injuries. The reason for separation (e.g. retirement, resignation, etc.) is not a factor in determining eligibility.

How do I make a claim?
You must complete the claim form and submit to the Health and Welfare Services, WA Police together with the Medical Certificate provided by the treating doctor and any other relevant information. Claim forms are available from WA Police Health and Welfare Services, WA Police Union, and the Insurance Commission of Western Australia.
